Snowbird Season Tax Traps: The Florida Residency Rules Tampa Retirees Need To Know

Florida levies no income tax, so the tax bill for a Tampa snowbird usually lands in the state the retiree left. That state decides whether a part-time Floridian still counts as one of its residents. A winter condo and a Florida mailing address do not settle the question.

Does Owning a Tampa Home Make Someone a Florida Resident?

Ownership and residency are separate matters. The Florida Department of State says there are no general rules for establishing residency, because residency attaches to a specific purpose such as taxes or tuition. For income tax, the controlling idea is domicile, the one place a person intends to remain permanently and returns to after time away. A person holds only one domicile, yet more than one state can still tax that person as a resident.

How Does The 183-Day Rule Work?

Florida has no 183-day rule, since the test comes from the state a snowbird left. New York, for example, treats a nonresident as a resident when that person keeps a permanent place of abode there and spends more than 183 days in the state. A retiree who logs 200 New York days with a home available there can owe tax on worldwide income despite a Florida license. We recommend that snowbirds keep a day record for the new state and the old one to maintain evidence.

What Counts as Domicile Documentation?

Auditors weigh the whole picture instead of a single document. Waverly Advisors identifies a retained vacation property and mismatched legal, financial, or medical records as common weak points. When spouses claim different domiciles, an auditor may argue the household still belongs to the old state. A Florida address that appears on tax returns, wills, and bank statements keeps the story consistent.

Which Steps Support a Residency Claim?

A Florida driver license is due within 30 days of establishing residency, and vehicles need Florida registration within 10 days. Voter registration is another recognized marker, and the state's own list of residency markers includes more than six consecutive months in Florida. A sworn Declaration of Domicile can be recorded with the circuit court clerk under Florida Statute 222.17. Updating both legal documents and tax filing information is crucial!

How Does the Homestead Filing Fit In?

Homestead removes up to $50,000 from assessed value, with the first $25,000 fully exempt and the second $25,000 excluding school taxes. The owner must hold title and live in the home on January 1, and the appraiser does not accept a license marked Valid in Florida. The statutory filing deadline is March 1, so an application for 2027 is due March 1, 2027. After the first year, assessment increases are capped at the lower of 3% or inflation, which works out to 2.7% for 2026. A wrongly claimed exemption can bring 50% penalties and 15% interest on up to ten years of back taxes, and Florida law bars claiming a residency exemption in two states at once.

What Happens for Part-Year Residents?

A part-year return splits the calendar year. New York taxes all income received while someone was a resident and only New York source income afterward, such as rent from a New York rental. A snowbird who moves mid-year therefore needs documents that support the move date, because that date separates the two tax treatments.

Retirees planning to split the year can start a daily calendar this fall and finish every pending Florida step before January 1. Oasis can work with a tax professional to test a residency plan against these steps ahead of any state inquiry.
